1. Who we are and what these terms cover

QRGEN lets you create QR codes for contact details, links, plain text, Wi-Fi networks and similar content. Depending on your plan and role, you can also save codes to a workspace, share them with colleagues, change where a dynamic code points, publish a digital business card, and see how often your codes are scanned.

In these terms, "we", "us" and "our" mean QRGEN. "You" means the person using the service. If you use the service for an organisation, you confirm that you may accept these terms on its behalf, and "you" then also means that organisation.

2. Your account

You can generate a single code as a guest. To save codes, work with a team or use the API, you need an account.

• You must be at least 13 years old to hold an account. If you are under 18, you need permission from a parent or guardian.
• Give accurate details when you register, and keep your email address up to date so that we can reach you about your account.
• Keep your password to yourself. You are responsible for what happens under your account until you tell us it has been compromised.
• Administrators may be required to turn on two-factor authentication before using the admin area.
• Tell us promptly at support@example.com if you think someone else has used your account.

3. Workspaces, members and roles

Codes, logos and scan records belong to a workspace rather than to one person. The person who creates a workspace owns it, and can invite others by email.

• Roles decide what each member may do. Owners and administrators manage members and settings, members create and edit codes, and viewers have read-only access.
• Only invite people who should see the workspace. Everyone in a workspace can see the codes, saved content and scan statistics in it.
• An invitation link is personal to the address it was sent to, and stops working once it is used or expires.
• The workspace owner decides who stays in the workspace. If you are removed, you lose access to its content immediately.

4. Your content and the codes you make

"Your content" means everything you put into the service: names, phone numbers, email addresses, links, text, Wi-Fi details, logos, photographs, card designs and imported spreadsheets.

• Your content stays yours. We do not claim ownership of it.
• You give us permission to store, copy, adapt and display your content only so far as we need to in order to run the service for you, for example to draw a logo into a code, build a business card page, or send you a file you asked for.
• You confirm that you are allowed to use the content you upload, including any logo, trade mark or photograph, and that using it through the service breaks no law and no one else's rights.
• If you encode someone else's personal details, such as an employee's phone number on a business card, you are responsible for having a lawful basis to do so and for telling that person how their details will be used.
• Deleting a code, a logo or a workspace removes it from the service. Backups may keep a copy for a short period before they are overwritten.

5. Acceptable use

You must not use QRGEN to:

• break the law, or help anyone else break it;
• point a code at malware, phishing pages, fraudulent payment pages, or any site that tries to deceive the person who scanned it;
• impersonate another person, business or brand, including by using their logo or name on a code or business card;
• publish content that is defamatory, obscene, hateful, or that sexualises children;
• collect personal information without the consent the law requires, or place codes where people are tricked into scanning them;
• send bulk unsolicited messages, or encode content that promotes them;
• interfere with the service, bypass usage limits or security controls, or try to read data belonging to another workspace;
• copy, resell or white-label the service as your own product without our written agreement.

We may check codes and destinations against safety and reputation services. We may refuse, block, pause or remove any code or link that we reasonably believe breaks these rules, and we may do so without notice where there is a risk to people who scan it.

6. Dynamic codes, short links and business cards

A dynamic code contains a short link on our domain. When someone scans it, we send them on to the destination you chose, or show the business card you published.

• You choose the destination and you are responsible for it, including keeping it safe, lawful and working.
• You can change the destination, pause a code, set an expiry date, limit the number of scans, or protect it with a password. Earlier destinations are kept so that you can switch back.
• A printed dynamic code stops working if you delete it, if your workspace is suspended, or if your account is closed. Plan for that before printing codes on physical items.
• Short links stay under our control. We do not guarantee that any particular short link will remain available forever, although we will not change or withdraw one without good reason.
• A published business card is a public web page. Anyone with the link can see what you put on it, so only publish details you are willing to share.

7. Scan records and analytics

When someone scans a dynamic code, we record the event so that we can show you statistics and protect the service. A record can include the time, the internet address (IP address) of the device, an approximate location worked out from it, the type of device, the browser and operating system, and the referring page.

• Scan records are kept for a limited period and then deleted automatically. The current retention period is set in the service configuration and is 90 days by default.
• Statistics are shown to members of the workspace that owns the code, and you can export them.
• If you are in the United Kingdom, the European Economic Area or a country with similar rules, you are usually the data controller for the scan records of your codes. You need your own privacy notice covering that, and you must handle requests from people whose data you hold.
• We may use aggregated, anonymous statistics to run and improve the service.

8. Free use and limits

QRGEN is free to use. There is nothing to buy, and the app asks for no payment details.

• Each workspace has a monthly allowance of generated codes, so that the service stays available to everyone. An administrator can change the allowance for a workspace.
• When a workspace reaches its allowance, generating more codes stops until the next month. Codes you have already made keep working.
• Other reasonable limits apply, such as the number of logos a workspace can store, the rows accepted in one bulk import, and how often the API may be called.
• We may change these limits. Where a change materially reduces what you get, we will tell you in advance if we reasonably can.
• If we introduce paid features in future, we will update these terms and tell you before anything is charged. Using the service today never becomes a paid subscription without your agreement.

9. API access and webhooks

• API tokens act as your password. Keep them secret, and revoke a token you no longer need or think has leaked. Tokens expire after a period set by us.
• Requests are rate limited. Do not try to work around the limits, and do not use the API to mirror or bulk copy the service.
• Webhooks send data to a URL you choose. You are responsible for that endpoint, for the data it receives and for keeping it secure. We may stop sending to an endpoint that fails repeatedly or points somewhere unsafe.
• We may change the API. Where a change breaks existing use, we will make reasonable efforts to tell you in advance.

10. The mobile app and Google Play

• We give you a personal, non-exclusive, non-transferable licence to install and use the QRGEN app on devices you control, for the purposes these terms allow.
• Google Play's terms also apply when you get the app from Google Play. If these terms conflict with Google Play's terms about distribution, Google Play's terms win for that point.
• QRGEN is responsible for the app and for support, not Google. Google is not a party to these terms.
• The app may ask for permissions on your device, such as access to the camera to scan a code, or to files so that you can choose a logo or save an image. You can refuse or withdraw a permission in your device settings, and some features will then not work.
• You must not copy, modify, decompile or reverse engineer the app, except so far as the law allows you to despite this restriction.
• We may release updates. Some updates are needed for the app to keep working, and older versions may stop being supported.
• You need a working internet connection for most features. Your network operator's charges are your responsibility.

11. Availability and changes to the service

We work to keep the service running, but we do not promise it will be uninterrupted or error free. We may carry out maintenance, add or remove features, or set reasonable limits on use. We may make changes to keep the service secure, lawful or workable. Where a change materially reduces what you get, we will tell you in advance if we reasonably can.

12. Suspension and termination

• You can stop using the service at any time. Ask us at support@example.com to close your account and delete its content.
• We may suspend or close an account or workspace, or remove content, if these terms are broken, if we are required to by law, or if there is a risk to other people, to the service or to people scanning your codes. Where we can, we will tell you why and give you a chance to put things right.
• A suspended workspace becomes read-only and its dynamic codes stop sending people on to their destinations.
• When an account is closed, its codes stop working and its content is deleted.
• Sections that by their nature should continue after the agreement ends, including sections 13 to 19, continue to apply.

13. Our intellectual property

The service, its software, design, text and logos belong to QRGEN or its licensors, and are protected by copyright and other rights. These terms do not give you any right in them except the limited right to use the service as described here. The codes and images you generate from your own content are yours to use.

If you send us feedback or a suggestion, we may use it without owing you anything for it.

14. Third-party sites and services

A code may point to a website we do not control, and the service relies on suppliers such as hosting providers, email delivery, font services and app stores. We are not responsible for third-party content or services, and including a link is not an endorsement of it.

15. Disclaimers

The service is provided "as is". So far as the law allows, we do not give any warranty that it will meet your needs, that every generated code will scan on every device or reader, that a destination will remain available, or that statistics will be complete or accurate. Test your codes before printing or distributing them. Nothing in these terms takes away consumer rights that cannot be taken away.

16. Limitation of liability

So far as the law allows, we are not liable for loss of profit, loss of business, loss of goodwill, loss of data, or for any indirect or consequential loss, including the cost of reprinting materials that carry a code. Our total liability to you for all claims connected with the service in any 12-month period is limited to the greater of the amount you paid us for the service in that period, or 50 US dollars.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

17. Your responsibility to us

If someone brings a claim against us because of your content, the destination of one of your codes, or your use of the service in breach of these terms, you agree to cover the reasonable losses, damages and costs we face as a result.

18. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If a change is significant, we will give reasonable notice, for example by email or a notice in the app, before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms. If you do not accept them, please stop using the service and ask us to close your account.

19. Governing law

These terms and any dispute arising from them are governed by the laws of the country in which QRGEN is established, and the courts of that country have exclusive jurisdiction.

If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
